Should small time drug offenders be released from prison

This has been a debate for many years and a debate I see as a valid one. Small time drug offenders should they be released and should they have been put there in the first place wasting tax payer dollars to put them there?
What is small time? In my eye's small time drug offender would be one who peddle's marijuana and marijuana only. Since marijuana is a earthly drug or medicine that doesn't need no more then a little dry time to cure the contents for it's usability I say drop a fine and keep them out of prison. So much taxpayer money has been wasted sending these small timers to prison then the whole stash taken was valued out on the streets.
Okay so you say gateway drug. Lets get one thing straight. Not everyone in society use marijuana and then move up the drug food chain. Some just simply love the effects of THC and go no further but what could happen is a little education on the use and the possibilities one may look for a more intense high.
Marijuana offenders aren't criminals in my eye's and last I checked marijuana didn't kill. Maybe it may lead to dealers or rivals to kill there own ranks but hey all in all we weed out the evil population and the thugs so where do we lose in this scenario. Now when we talk about crack, cocaine, meth, opium, heroine and the many other process drugs and then we step into a much broader orginization of killers. Marijuana has been used since the beginning of time in one or more ritual of rights and did I say there hasn't been one death logged at over dosing on marijuana. Normally once your high your high and your not getting any higher then you already are once it's there.
Let the potheads go and go after the real drugs of serious issues. We already have many laws on marijuana and fines. I think it's far past time we legalize it and the government start using this drug of choice to reap and replenish the social security and various funds from the taxation this drug of many wonders can help draw and produce.
